Top German state court rules that unlicensed operator must reimburse player

The Köln Higher State Court (Oberlandesgericht), the highest state court in Germany's most populous state Nordrhein-Westfalen, has ruled that Pokerstars must reimburse a player’s losses because online casino was not yet legal in the state at the time the losses occurred.

The ruling overturns a lower-court decision that found in favor of the operator.

The court ruled that Pokerstars had not made it clear that online casino games were illegal in most of Germany at the time, instead “giving the impression of legality” through the use of a German-language website and customer service.

Dutch government coalition proposes 0.5% gambling tax rate increase

MPs representing the four parliamentary groups making up the current government coalition (VVD, D66, CDA, and CU) have tabled an amendment proposing to increase the current 29% gambling tax rate to 29.5%.

The amendment follows an earlier government proposal to increase the current gambling tax rate by 0.3%.

As the four parliamentary groups have a majority in the Lower House, the proposed increase is all but certain to be adopted.

The amendment follows the recent adoption of a motion by the Lower House that canceled a planned gambling tax decrease from 29% to 25% of GGR.
