The works council of Holland Casino has filed a final appeal against the recent Appeal Court’s decision that the state-owned casino operator is allowed to transform itself from a non-profit foundation into a limited liability company. The appeal will be judged by the Supreme Court of the Netherlands.

Advocate-General Maciej Szpunar of the Court of Justice of the EU issued an opinion stating that EU member states, where gambling is legal, may not institute ISP blocking measures against foreign gambling operators in the absence of an objective, transparent, non-discriminatory and proportionate licensing procedure.

Szpunar also confirmed an earlier finding that a member state is precluded from sanctioning an operator (whether criminal or administrative) holding a license in another member state where the licensing process infringes the transparency obligation and where the national regime is in violation of EU law.
